1. ACCEPTANCE OF TERMS

By accessing, downloading, or using the Kartup AI mobile application or the kartupai.com websites (collectively, the "Platform"), you ("The User") agree to be bound by these Terms and Conditions. This Platform is owned and operated by Kartup AI Technologies. If you do not agree to these terms, you must immediately cease all use of the Platform.

2. NATURE OF SERVICE

Kartup AI is a shopping assistant. You describe what you want to buy, and the Platform searches the Indian retailers it supports and reports what it found. Each result carries:

• The retailer it came from and a link to that retailer's own page.
• The price that retailer listed, together with when we last read it.
• Any offer we found stated on the listing, and what we could not confirm.
• A short written summary, produced by a large language model (Google Gemini), of why the item is being shown.

The Platform does not predict future prices, does not hold a profile of your bank cards, and does not issue a buy-or-wait verdict.

Disclaimer of Guarantee: Every price and offer shown is what we read at the retailer at the time stated, not a quote. Prices, stock, offer eligibility and delivery terms change without notice, and the retailer's own checkout page is the only binding figure. The written summaries are model output and can be wrong. Kartup AI is an information provider, not a retailer, and not a financial adviser.

3. LIMITATION OF LIABILITY (THE "RELIANCE" CLAUSE)

Under no circumstances shall Kartup AI, its developers, or its management be held liable for:

• Price Fluctuations: Any financial loss incurred because a price changed after we read it.
• Inventory Issues: Products going out of stock. The Platform does not track retailer stock levels.
• Offer Discrepancies: Variations between an offer as stated on a retailer's listing and what the retailer or your bank actually applies at checkout.
• Third-Party Errors: Technical glitches on Amazon, Flipkart, or other merchant sites.

Maximum Liability: In any event, the total liability of Kartup AI for any claim shall not exceed the amount of ₹0.00, as the service is currently provided free of charge.

4. DATA PRIVACY & DPDP COMPLIANCE (2026)

In accordance with the Digital Personal Data Protection (DPDP) Act, Kartup AI maintains the following standards:

• Bank Data: We collect and store no financial data at all. Not card numbers, CVV or PINs, and not your bank name or card type either. There is no bank profile in the product.
• Consent: By searching, you consent to your search wording, and any photo or voice note you send, being processed by Google Gemini, and to your search wording being sent to the search providers listed in the Privacy Policy.
• Right to Erasure: You can request deletion of your account and its data from the "Delete my account" control in Profile settings, or by emailing [email protected]. See the Privacy Policy for how the request is handled and how long it takes.

5. AFFILIATE & THIRD-PARTY LINKS

The Platform contains links to third-party marketplaces (Amazon, Flipkart, etc.).

Kartup AI uses Cuelinks and other affiliate networks.

When you click a link and make a purchase, we may earn a commission. This does not increase your cost.

We are not responsible for the delivery, quality, or warranty of the products purchased. All disputes regarding the physical product must be taken up with the respective merchant.

6. INTELLECTUAL PROPERTY

The search and ranking logic, the "Kartup AI" logo, and the site design are the exclusive intellectual property of Kartup AI. Any attempt to reverse-engineer our scraper, bot our API, or "scrape the scraper" will result in an immediate IP ban and potential legal action under the Information Technology Act, 2000.

7. USER CONDUCT & PROHIBITED USE

Users agree not to:

• Use any automated system (bots, spiders) to access the Platform.
• Submit false feedback or bug reports to manipulate the AI's learning model.
• Use the Platform for any commercial resale or price-arbitrage scouting without prior written consent.

8. MODIFICATION OF SERVICE

Kartup AI reserves the right to modify or discontinue the Service (or any part thereof) with or without notice. We specifically reserve the right to introduce a "Pro Plan" or "Premium Tier" in the future, although the initial 6 months of service are committed as free-to-use.

9. GOVERNING LAW & JURISDICTION

These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in Maharashtra, India.
