1. ACCEPTANCE OF TERMS

By accessing, downloading, or using the Kartup AI mobile application or the kartupai.com websites (collectively, the "Platform"), you ("The User") agree to be bound by these Terms and Conditions. This Platform is owned and operated by Kartup AI Technologies. If you do not agree to these terms, you must immediately cease all use of the Platform.

2. NATURE OF SERVICE (THE "AI VERDICT")

Kartup AI provides an artificial intelligence-driven shopping assistant. The Platform utilizes the "Deep Scan" feature to provide:

• Price Prediction: Based on historical data and AI analysis.
• Bank Logic Calculations: Automated estimation of discounts based on user-selected bank card profiles.
• The Verdict: "Gold Buy" or "Silver Wait" status.

Disclaimer of Guarantee: All verdicts, badges, and "effective prices" are estimates generated by a Large Language Model (Gemini AI). Kartup AI does not guarantee that these prices will be available at the time of your checkout. We are an information provider, not a retailer or financial advisor.

3. LIMITATION OF LIABILITY (THE "RELIANCE" CLAUSE)

Under no circumstances shall Kartup AI, its developers, or its management be held liable for:

• Price Fluctuations: Any financial loss incurred because a user "Waited" on a product and the price increased.
• Inventory Issues: Products going out of stock while the user was performing a Deep Scan.
• Bank Offer Discrepancies: Variations between the Platform's calculated discount and the bank's final statement credit.
• Third-Party Errors: Technical glitches on Amazon, Flipkart, or other merchant sites.

Maximum Liability: In any event, the total liability of Kartup AI for any claim shall not exceed the amount of ₹0.00, as the service is currently provided free of charge.

4. DATA PRIVACY & DPDP COMPLIANCE (2026)

In accordance with the Digital Personal Data Protection (DPDP) Act, Kartup AI maintains the following standards:

• Bank Data: We do not collect or store Credit/Debit card numbers, CVV, or PINs. We only store the "Bank Name" and "Card Type" as per your profile settings.
• Consent: By using the Deep Scan feature, you consent to the processing of your search queries by our AI partner (Google Gemini).
• Right to Erasure: Users may request the permanent deletion of their account and all associated search history via the "Profile" settings. Kartup AI commits to wiping this data from its Database servers within 72 hours of the request.

5. AFFILIATE & THIRD-PARTY LINKS

The Platform contains links to third-party marketplaces (Amazon, Flipkart, etc.).

Kartup AI uses Cuelinks and other affiliate networks.

When you click a link and make a purchase, we may earn a commission. This does not increase your cost.

We are not responsible for the delivery, quality, or warranty of the products purchased. All disputes regarding the physical product must be taken up with the respective merchant.

6. INTELLECTUAL PROPERTY

The "Deep Scan" logic, the "Bank Logic Engine" algorithm, the "Kartup AI" logo, and the custom Glassmorphic UI design are the exclusive intellectual property of Kartup AI. Any attempt to reverse-engineer our scraper, bot our API, or "scrape the scraper" will result in an immediate IP ban and potential legal action under the Information Technology Act, 2000.

7. USER CONDUCT & PROHIBITED USE

Users agree not to:

• Use any automated system (bots, spiders) to access the Platform.
• Submit false feedback or bug reports to manipulate the AI's learning model.
• Use the Platform for any commercial resale or price-arbitrage scouting without prior written consent.

8. MODIFICATION OF SERVICE

Kartup AI reserves the right to modify or discontinue the Service (or any part thereof) with or without notice. We specifically reserve the right to introduce a "Pro Plan" or "Premium Tier" in the future, although the initial 6 months of service are committed as free-to-use.

9. GOVERNING LAW & JURISDICTION

These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in Maharashtra, India.
